Music of Vienna
These terms and conditions apply to all sales of tickets for concerts, events and concert packages — leisure activities with fixed time and place — by distance selling from us, Music of Vienna, Blumberggasse 4/3, 1160 Vienna, Austria, as seller, to you as buyer, in the version current at the time of the order.
We reserve the right to update or modify these terms and conditions from time to time. Last update April 2018.
Offers, confirmation and acceptance
The offers on our website are without obligation and non-binding and can be withdrawn or revised anytime prior to accepting your order. All prices stated are total prices including all applicable fees and charges and statutory VAT. We do not add any additional costs to the prices stated. Ticket delivery takes place electronically and incurs no shipping or handling fees.
An order submitted by you and subsequent payment constitutes a binding offer by you to us to purchase tickets on these terms and conditions. All orders are subject to our subsequent acceptance.
Prior to our acceptance, an automated confirmation email about your order will be sent to you. This order confirmation must be checked immediately and any noticeable deviations from the order placed must be claimed by email without delay. This automatic confirmation does not constitute our acceptance of your order. If you pay by bank transfer, the order confirmation will be sent when the full amount of your order is credited to our bank account.
We accept this offer by sending you a reservation confirmation by email with your reservation number, the contract text and, unless explicitly stated otherwise, a printable copy of your tickets. You can then either pickup your tickets at the entrance with your name and reservation number or print out a copy of your tickets in advance.
We do not store the contract text after conclusion of the contract.
Although we make every effort to ensure that the offers shown on our site are up-to-date, we do not guarantee availability at the time of your order. Should we be unable to process or carry out your order, because for example a concert has already sold out at the time of your order, we can decline your order without further liability or obligation. In this case we will inform you immediately and, if no alternative date or concert can be arranged, refund any payments made.
Available payment options are: All major credit card brands (Visa, Mastercard, American Express, Diners Club and JCB), online instant bank transfer with SOFORT, PayPal and bank transfer. Group orders for more than 20 people may also be paid on invoice within the EU.
Personal information
By placing your order, you agree to the electronic processing of your information as described in our privacy policy and confirm that the information provided by you is up-to-date, accurate and sufficient for us to fulfill your order.
Any personal information provided while ordering will be used exclusively to fulfill your order and, with the exception of your name, resp. the ticket holder’s name, never shared with third parties. If a third party is directly involved in the completion of your order, we will only share your reservation number and your name or the card holder’s name (for example to reserve seats at a restaurant).

Provisions for your concert visit
By attending the concert you accept the house rules of the venue, and, if we are not the organiser of a particular event, all rules and regulations of the organiser.
Taking pictures, filming and recording during the performance is not allowed. Please note that the performances are protected under copyright and related laws.
You consent to the publishing or other use of any image of your person recorded by chance in the course of any type of recording, in particular photography, television, film or video recordings during the event.
Unless expressly stated otherwise, bringing children under the age of 2 is not permitted.
Admittance after the start of the performance is in most cases not possible.
Withdrawal and cancellation
According to the Distance Selling Act for leisure services with fixed time and place a cancellation is principally ruled out. However, provided that you inform us early enough, we will try to arrange a cancellation in goodwill and arrange for a full or partial refund of the ticket price.
We reserve an unilateral right of withdrawal for events of force majeure and impossibility (like for example a cancellation of the concert). In any such event we will inform you immediately by email and, if no alternative date or concert can be arranged, refund the ticket price.
Limitations of liability
If we are not the organiser of a particular event and the fault is attributable to the organiser, including, but not limited to, cancellation, postponement or relocation of an event, claims against us are ruled out.
A liability for slight negligence with the exception of injury to life, body or health, especially regarding, but not limited to, the completeness, up-to-dateness and correctness of the information on our website like data and information about visibility conditions, program, cast, seating assignment and arrangement, execution and quality of a performance, is ruled out. Changes and errors excepted.
In no case shall we be liable or provide compensation for incidental, indirect or consequential damages and financial losses, including but not limited to travel or transport costs, unrealized or lost profits, loss of interest or damages resulting from third party claims.
Closing provisions
This contract is governed by Austrian law under exclusion of international private law and of UN sales law. The place of jurisdiction shall be the applicable court responsible for such matters in Vienna. The place of fulfillment is the place of the performance.
If individual provisions of this agreement are or become wholly or partially invalid or inapplicable, a valid and admissible provision shall be deemed agreed that comes as close as possible to the original purpose. The validity of the rest of the contract remains unaffected.
We are not obliged to and do not agree to take part in dispute resolution proceedings before Consumer Arbitration Boards.
Changes and additions to this contract require written form for their effectiveness.
This is a translation of the German Allgemeine Geschäftsbedingungen. If there are inconsistencies or misunderstandings between the German version and this translation, or clarifications required, the German version shall prevail.
